Can a contract be made between two parties so their heirs can inherit the property after they have passed away?

Question:

Asalamu alaikum I hope you’re well. There’s a property that’s owned by two individuals. I’d like to know if it’s permissible for these two individuals to make a contract stating that the property will only be distributed to their heirs after the death of both individuals. Furthermore if one individual dies the other should have the right to use the property until they die. Assistance will be highly appreciated. Was Salam

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu’ alaykum wa-raḥmatullāhi wa-barakātuh.
Shirkah and Islamic partnerships terminate with the death of any of the partners and the share of the deceased is immediately trnasferred to his or her heirs. Thus, the jurists have mentioned that due to this immediate transfer, the partnership stands terminated between the original partners. However, if all parties wish, they can continue the partnership as a new partnership  between the original partner and the heirs as new partners.
